U.S. Specialist Explains the Impacts of New U.S. Tariffs on Brazilian Natural Stones

 

With a warning that incorrect classification can lead to penalties on exports, and emphasizing the importance of sending material samples for laboratory analysis when necessary, the webinar brought together more than 170 participants.

 

The recent changes in tariffs imposed by the United States on Brazilian natural stones require heightened attention from exporters and importers. Aware of this scenario, the Brazilian Natural Stone Association (Centrorochas) held the webinar “HTSUS Decoded: Navigating U.S. Tariff Rules for Brazilian Natural Stones”, featuring customs broker and president of A Customs Brokerage, Gabriel Rodriguez. Known for his extensive experience in the nationalization of goods in the U.S., the specialist outlined the main aspects of the U.S. tariff system (HTSUS) and provided guidance to reduce risks and avoid losses.

 

At the outset, Rodriguez praised Centrorochas’ tireless efforts and its partnerships with the NSI (Natural Stone Institute) and NAHB (National Association of Home Builders). According to him, the inclusion of quartzite on the exemption list was a direct result of this intensive international coordination. However, he stressed that other materials, such as marble, granite, and slate, remain subject to the additional 40% tariff, leaving the sector in a situation of significant commercial vulnerability.

 

During his presentation, Rodriguez explained that the HTSUS is the official system for classifying goods imported into the United States, and that it differs from the Mercosur Common Nomenclature (NCM) used in Brazil. Code conversion occurs only at the time of nationalization, with the U.S. importer being legally responsible for proper classification. Incorrect classifications, he warned, can result in severe penalties.

 

Among his practical recommendations, he highlighted:

  • The importance of sending samples for laboratory analysis, when necessary, to confirm the correct classification;
  • The use of binding rulings (binding decisions issued by U.S. Customs) as a tool to ensure legal certainty and predictability;
  • Caution with incomplete or generic descriptions, which increase the risk of disputes;
  • The application of the on-the-water rule, which allows tariff exemptions for shipments that left the port of origin before the effective date of the new tariff, provided they meet specific direct transit requirements.

 

The specialist further emphasized that, given the complexity of the changes, it is essential for exporters and importers to maintain constant communication and align commercial and documentary information in advance. “This diligence is key to avoiding mistakes that can lead to additional costs or delays,” he advised. In his view, understanding the logic and requirements of the U.S. tariff system has become a competitive advantage for Brazilian companies aiming to maintain and expand their presence in the U.S. market.

 

Association Reinforces Strategic Role

At the opening of the event, held on August 7, Centrorochas president Tales Machado highlighted the association’s intensive work in defending the sector’s interests and thanked the commitment of partner institutions, both in the U.S. and in Brazil. Tales reaffirmed the commitment to continue working to minimize the effects of the new tariffs, especially on marble, granite, and slate, which are still subject to high taxation.

 

During the interactive segment, vice president Fábio Cruz led the discussion with the guest speaker, exploring practical cases and addressing questions submitted by participants, which brought greater clarity on procedures and critical points of the tariff system.
